Legal bases for EU users

Where EU or similar privacy law applies, we rely on contract necessity to provide the service, legitimate interests to secure and improve Peak Dive, consent where required, and legal obligation when we must keep or disclose information under applicable law.

Training and fitness data

Training and fitness-related data can be sensitive. Peak Dive does not use training or fitness data for advertising, third-party marketing, or tracking. The first App Store version does not connect to wearable health data providers or platform health databases. Peak Dive is not a medical device and does not provide diagnosis, treatment, or medical advice.

Sharing and service providers

We do not sell personal data. We may share data with service providers that help operate Peak Dive, such as hosting, authentication, storage, email, support, diagnostics, and security providers. Service providers are expected to protect data consistently with this policy and applicable law.

Team access

Peak Dive is built for teams. Coaches, administrators, or other authorized team members may be able to view account, athlete, training, and progress context according to the permissions configured for that team. Teams are responsible for making sure they have the necessary rights and consents before entering athlete information.

Retention and deletion

We keep data for as long as needed to provide Peak Dive, comply with legal obligations, resolve disputes, maintain security, and support team records. Users can request deletion, correction, export, or consent revocation by emailing support@peakmotionlabs.com. Some records may need to be retained for a limited time in backups, audit logs, or team records where required by law or a team agreement.

Your rights

Depending on where you live, you may have rights to access, correct, export, delete, object to, restrict, or withdraw consent for certain data processing. You can start a request at support@peakmotionlabs.com. You may also have the right to complain to your local data protection authority.

International processing

Peak Dive may use service providers in countries outside your own. Where required, we use appropriate safeguards for international transfers, such as contractual protections or other legally recognized transfer mechanisms.

Children and minors

Peak Dive is not directed to children. Users must be at least 16 years old unless access is provided through an authorized team, parent, guardian, school, or organization with the required permissions. If you believe a minor's data was added without authorization, contact support@peakmotionlabs.com.
