Terms of Use

These terms explain the rules for using Peak Dive, the invite-only diving training planning service operated by Moritz Wesemann.

Effective date: June 27, 2026

Acceptance

By accessing or using Peak Dive, you agree to these Terms and the Privacy Policy. If you use Peak Dive for a team, club, school, or organization, you confirm that you are allowed to use Peak Dive on that organization's behalf.

Invite-only access

Peak Dive is currently available only to invited or provisioned accounts. Public signup is not available. If you downloaded the app but do not have an account, contact support@peakmotionlabs.com or your team administrator.

Age and team responsibility

Peak Dive is intended for users who are at least 16 years old, unless access is provided through an authorized team, parent, guardian, school, or organization. Coaches and team administrators are responsible for making sure athlete data is entered lawfully and with the permissions required by their organization and local law.

Using Peak Dive responsibly

  • Keep login credentials secure and do not share accounts.
  • Enter only data that you are authorized to use in Peak Dive.
  • Do not upload unlawful, harmful, misleading, or infringing content.
  • Do not attempt to disrupt, reverse engineer, scrape, or misuse the service.
  • Do not use Peak Dive to make medical decisions or emergency decisions.

Training and health information

Peak Dive helps teams organize diving training and review progress. It is not a medical device and does not provide medical advice, diagnosis, treatment, or emergency services. Training and progress data should be used as context only. Athletes should consult qualified professionals before making medical or health decisions.

Third-party services

Peak Dive may rely on third-party service providers for hosting, authentication, email, diagnostics, or support. Third-party services are governed by their own terms and privacy policies. The first App Store version does not include a wearable or health-data integration.

Pricing and App Store purchases

Peak Dive does not currently offer App Store in-app purchases, subscriptions, or public pricing. If paid plans launch later, the applicable pricing and billing terms will be provided before payment is required.

Ownership and feedback

Peak Dive, including its software, design, branding, and documentation, belongs to Moritz Wesemann or licensors. You keep rights to data and content you are authorized to enter, but grant Peak Dive the rights needed to host, process, display, and operate that content for the service. If you send feedback, we may use it to improve Peak Dive without obligation.

Service changes and availability

Peak Dive is in active development. Features may change, be limited, or be discontinued. We aim to keep the service reliable, but we do not guarantee uninterrupted or error-free availability.

Suspension and termination

We may suspend or terminate access if an account violates these Terms, creates security risk, infringes rights, or is no longer authorized by its team. You may request account deletion or data assistance through support@peakmotionlabs.com.

Disclaimers and liability

Peak Dive is provided on an as-available basis. To the maximum extent allowed by law, Moritz Wesemann is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or decisions made using training or health context in Peak Dive. Nothing in these Terms limits liability that cannot legally be limited.

Governing law

These Terms are intended to be governed by German law, excluding conflict-of-law rules, unless mandatory consumer protection law gives you additional rights.
